审级改革背景下委托诉讼代理的制度反思

Rethinking on the Litigation Agency System under the Reform of Judicial Hierarchy

诉讼代理的形式由民事诉讼的功能定位决定。审级职能定位改革后,民事诉讼各审级的功能定位将发生转变,诉讼代理形式也应随之变化,我国法律服务市场的结构变动为此提供了条件。应适时重构我国委托诉讼代理制度,区分审级与法院层级以采用不同代理形式,初审保留公民代理,上诉审与再审采用职业代理,由最高人民法院审理的案件实行强制律师代理,并采用法官指定代理作为制度补充。

The form of litigation agency is determined by the functional orientation of civil litigation.After the reform of the functional orientation of judicial hierarchy,the function of civil litigation will be changed,and the form of litigation representation should be changed accordingly.The structural changes of legal service market provide conditions for it.China should timely reconstruct litigation agency system,adopt different forms of agency according to the judicial hierarchy and court level.Citizen agency shall be retained in the first instance,professional agency shall be adopted in the appeal and retrial,and compulsory lawyer agency shall be implemented in cases tried by the Supreme People s court,supplemented by judge-appointed representation.
