现行港口国监督中止检查以及缺陷纠正和释放船舶程序执行研究

Study on Procedure Implementation of the Existing Port State Control Suspension Inspection and Deficiency Rectification as Well as Vessel Release

现行国际海事组织《港口国监督程序》(Resolution A.1155(32))以及各港口国监督谅解备忘录已在船舶违规以及滞留章节中,对中止检查、纠正缺陷和解除滞留等程序作出相关规定,但各国在实际执行时存在不一致、不协调的问题。通过对上述问题进行分析,就协调统一相关执行行动提出合理化建议,以促进世界港口国监督活动和程序执行的标准化。

The paper analyzes the inconsistent and uncoordinated implementation of the provisions on suspension of inspection,rectification of defects and release of detention according to the provisions of the current Procedure for Port State Control(Resolution A.1155(32)) developed by IMO on contravention and detention and memorandums of understanding on port state control throughout the world. It also puts forward suggestions from the perspective of coordinating enforcement, so as to unify global PSC activities and procedures.
