《民法典》背景下我国劳动者个人信息保护研究

大数据时代个人信息侵权事件频发,《民法典》在“人格权编”专设“隐私权和个人信息保护”一章,突出了新时代对个人信息保护的重视。劳动者个人信息保护不仅是个人信息保护制度在具体领域适用的重要环节,也是劳动者权益保护的必然要求。然而,目前我国对于劳动者个人信息保护重视不够、力度不足。对此,有必要充分认识其重要意义,解释适用《民法典》有关个人信息保护的有关规定,并从立法、监管、用人单位、劳动者等多个维度加强我国劳动者个人信息保护。

In the era of big data,personal information infringement incidents occur frequently.Civil Code has a special chapter"Rights to Privacy and Protection of Personal Information"in the"Personal Rights Edition",highlighting the importance of personal information protection in the new era.The protection of personal information of employees is not only an important link in the application of the personal information protection system in specific fields,but also an inevitable requirement for the protection of employees′rights and interests.However,at present,our country has not paid enough attention and efforts to the protection of employees′personal information.In this regard,it is necessary to fully understand its significance,explain and apply the relevant provisions of the Civil Code on the protection of personal information,and improve the protection of employees′personal information in China in many specific ways such as legislation,supervision,employers and employees themselves.
