On the Rule of Law as the Core Socialist Values

社会主义核心价值观包含了“法治”这个价值要素。党的十九届四中全会又提出:“建设中国特色社会主义法治体系、建设社会主义法治国家是坚持和发展中国特色社会主义的内在要求。”把这两个方面结合起来,可以提炼出一个基础性的命题——法治作为社会主义核心价值。这个命题的理论内涵可以从多个方面来阐释:一方面,着眼于中华文明在近代的转型,随着经学时代的终结与法理时代的兴起,把法治作为社会主义核心价值,可以为走向法理时代的中华文明做出一个有效的思想回应。另一方面,着眼于社会主义的发展历程,把法治作为社会主义核心价值,有助于吸取斯大林时代苏联社会主义的教训,有助于满足科学社会主义对社会公正与自由个性的期待。回到“法治作为社会主义核心价值”这个命题本身,它有一个坚固的思想根基,那就是科学社会主义;它也有一项坚实的政治原则,那就是坚持中国共产党的领导;它还有一个体系化的制度安排,那就是法治。

Core socialist values embody the value element of“rule of law”.The Fourth Plenary Session of the 19th CPC Central Committee also make the following requirement for the work:“Building a socialist legal system with Chinese characteristics and a socialist country under the rule of law is the internal requirement for adhering to and developing socialism with Chinese characteristics.”From the above two aspects,we can extract a basic proposition:The rule of law as the core of socialist values.The theoretical connotation of this proposition can be explained from the following two parts.The first part is about the transformation of Chinese civilization in modern times.With the end of the era of Confucian classics and the rise of the era of jurisprudence,the rule of law as the core values of socialism gives an effective ideological response to the Chinese civilization moving towards the era of jurisprudence.The second part is about the development process of socialism.The rule of law as the core of socialist values will help to learn the lessons of Soviet socialism in the Stalin era and meet the expectations of scientific socialism for social justice and freedom.Rethinking the proposition of the“rule of law as the core of socialist values”,we find this proposition has three characteristics:Scientific socialism as a solid ideological foundation,the leadership of the CPC as a solid political principle,and the rule of law as a systematic institutional arrangement.
