解放战争时期的惩贪司法治理——参见哈尔滨市中级人民法院馆藏档案卷宗

Judicial Governance Against Corruption During the Liberation War——As Seen in Archives Collected in Harbin Intermediate People’s Court

对贪腐问题严抓严打、绝不手软是中国共产党的一贯作风。哈尔滨解放区作为全国最早解放的大城市,在经济发展的同时不可避免地存在一些贪腐问题。通过对哈尔滨市中级人民法院馆藏档案卷宗的考察,发现1946—1949年间,哈尔滨解放区法院共审判贪污案件331件,贪污犯罪在犯罪构成、裁判依据、处罚措施与处罚原则等方面颇具时代特色,具有惩前毖后大力打击贪污犯罪、重视思想教育清除腐化作风、法学专业性不高司法实践中不重视程序、带有应急性与阶级性色彩的特点。

It is the consistent style of the Communist Party of China to strictly crack down on corruption issues and never be soft-hearted.As the earliest liberated big city in the country,the Harbin liberated area inevitably had some corruption problems along with its economic development.Through the investigation of the archives collected in Harbin Intermediate People’s Court,it is found that from 1946 to 1949,the Harbin Liberated Area Court tried a total of 331 corruption cases.These cases had some characteristics of the times from the perspective of crime constitution,decision basis,punishment measures and punishment principle.They had the characteristics of vigorously cracking down on corruption crimes by learning lessons from the past to avoid future mistakes,attaching importance to ideological education to eliminate corrupt work styles,not being highly specialized in legal studies,not paying attention to procedures in judicial practice,and having the characteristics of emergency and class nature.
