数字版权领域反垄断规制的范式革新

Paradigm Innovation of Antitrust Regulation in the Field of Digital Copyright

数字版权领域存在相关市场界定难、垄断归因难的两难问题,传统反垄断分析范式无法有效规制。具体看,“版权排他性”和“数字技术”两者结合会产生市场支配力,使经营者得以影响、控制作品交易市场秩序并排除限制竞争,且垄断行为的实施无需相关市场规模作为结构支撑。“强化行为监管、跳出结构分析框架限制”,新修订的《反垄断法》第9条从制度供给层面为数字版权的反垄断规制提供了范式转换的契机,监管层面也不应苛求垄断结构的存在,囿于传统分析范式,而要强化行为监管,直接评价经营者的行为性质,规制违法垄断行为。

In the field of digital copyright,there are dilemmas such as the difficulty of defining the relevant market and the difficulty of attributing monopoly power,and the traditional anti-monopoly analysis paradigm cannot be effectively regulated.Specifically,the combination of"copyright exclusivity"and"digital technology"will generate market power,allowing operators to influence and control the order of the work trading market and eliminate restrictions on competi⁃tion,and the implementation of monopolistic behavior does not require the relevant market size as a structural support."Strengthen behavior supervision and jump out of the framework of structural analysis."The newly revised Article 9 of the Anti-Monopoly Law provides an opportunity for paradigm shift in the anti-monopoly regulation of digital copyright from the institutional supply level,and the regulatory level should not demand the existence of a monopoly structure,confined to the traditional analysis paradigm,but to strengthen behavior supervision,directly evaluate the nature of the operator's behavior,and regulate illegal monopoly behavior.
