论鼓励创新作为《反垄断法》立法目的

"Encouraging Innovation"as the Legislative Purpose of the Anti-Monopoly Law

《反垄断法》立法目的条款具有重要地位和功能,其变动和理解适用需要得到系统和充分的学理论证和阐释。在《反垄断法》第1条中的“保护市场公平竞争”后增加“鼓励创新”具有现实必要性和逻辑合理性。首先,解析竞争、垄断与创新关系的经济学研究可知,《反垄断法》将鼓励创新作为立法目的之一,能更好地回应数字经济时代创新发展的现实需求。其次,从部门法体系的角度出发,自上而下地解析促进社会主义市场经济健康发展这一根本目的可知,新增“鼓励创新”至“保护市场公平竞争”目标之后十分吻合反垄断立法目的体系的层次结构;从《反垄断法》的规范体系出发,基于规则是对原则的抽象且根源于目的的归纳逻辑,自下而上地分析发现《反垄断法》确有新增“鼓励创新”立法目的的逻辑需要。

The legislative purpose clause of the Anti-Monopoly Law has an important status and function,and its revi⁃sion needs to be systematically and fully demonstrated and explained.Adding"encouraging innovation"after"protect⁃ing fair competition in the market"in Article 1 of the Anti-Monopoly Law is practically necessary and logically reason⁃able.Firstly,economic research analyzing the relationship between competition,monopoly and innovation shows that if the Anti-Monopoly Law regards encouraging innovation as one of its legislative purposes,it can respond to the real needs of innovation and development in the digital economy era.Secondly,from the perspective of the departmental le⁃gal system,by analyzing the fundamental purpose,we can see that the addition of"encouraging innovation"to the goal of"protecting fair market competition"is very consistent with the hierarchical structure of the legislation purpose sys⁃tem.Besides,starting from the normative system of the Anti-Monopoly Law,a bottom-up analysis finds that the Anti-Monopoly Law does need to add the purpose of"encouraging innovation".
