创新驱动背景下我国互联网合理使用制度研究——兼论《著作权法》第24条修订建议

Research on Internet Fair Use System under the Background of Innovation Driven——Also on the Revision Proposal of Article 24 of the Copyright Law

互联网环境下的文化与技术创新需要更包容、更广泛的作品使用方式,但我国立法规定的合理使用制度存在封闭性、保守性缺点,未能结合互联网环境下出现的新情况、新特点与时俱进。从互联网环境下创新驱动的本质特征出发,探究合理使用与创新发展之间的内在机理,合理使用制度在互联网环境下因与模仿创新、开放创新、社群创新之内在契合,使其成为驱动创新的重要机制。从比较法的视角探讨域外国家通过合理使用制度来促进本国创新驱动发展的科学进路和有益经验,得出我国应建构更为开放的合理使用制度立法模式:优化一般条款,引进生产性合理使用、文本与数据挖掘合理使用、附带性合理使用具体条款,并遵循比例原则,探寻和评估各合理使用条款的制度意涵、功能优势、工具强度、适用条件等因素,配置旨在驱动创新的合理使用制度工具。

Cultural and technological innovation in the Internet environment requires a more inclusive and extensive way of using works.However,the fair use system stipulated in my country's legislation has the shortcomings of being closed and conservative,and it fails to combine the new situation and new characteristics in the Internet environment.Starting from the essential characteristics of innovation driven in the Internet environment,explore the internal mecha⁃nism between fair use and innovation.In the Internet environment,the fair use system is inherently compatible with imitation innovation,open innovation,and community innovation,making it is an important mechanism of innovation driven.From the perspective of comparative law,it discusses the scientific approach and beneficial experience to pro⁃mote innovation-driven development through the fair use system,and concludes that my country should build a more open legislative model of the fair use system:optimize general terms and introduce productive fair use,text and data mining fair use,incidental fair use as specific terms,and follow the proportionality principle to explore and evaluate the institutional implications,functional advantages,tool strength,and applicable conditions of each fair use clause.
