宅基地使用权市场化是宅基地三权分置的重要途径,当前宅基地这一“沉睡”要素到了必须放活的窗口期,这是乡村振兴发展的需要。在宅基地使用权市场化过程中,不可避免会遇到一系列问题阻碍其市场化进程。基于此,文章从法理、历史和农民群体等视角出发,有针对性地给出相应的合理化建议。

The marketization of the right to use the homestead is an important way to split the three rights of the homestead.At present,the “sleeping” element of the homestead has reached a window period that must be activated,which is the need of rural revitalization and development.In the process of marketization of homestead use right,a series of problems will inevitably be encountered to hinder its marketization process.Based on this,the article gives corresponding reasonable suggestions from the perspectives of jurisprudence,history and peasant groups.
