我国城乡规划制度运行效能改革思路研究

在土地利用总体规划与城市总体规划整合趋势明显的时代背景下,建设用地的边界划定与规划技术标准都将得到统一。以控制性详细规划制度为核心的城乡规划制度需要进一步完善,以适应“两规合一”为基础的“多规融合”需要。在规划的编制与修改过程中需要重视公众参与、信息公开等工作,为规划委员会制度与规划听证制度的改进创造条件。完善以规划条件为依据的规划许可制度,需要加强全程监管工作,以确保在推进并联审批等改革的同时有力维护规划秩序。完善合理补偿、申诉救济制度是平衡建设自由与建设管制关系的必要条件。

Under the background of the obvious integration trend between the overall-land-use planning and the overall-urban-planning,the boundary delimitation and planning technical standards of construction land will be unified.The urban and rural planning system with the regulatory detailed planning system as the core needs to be further improved to meet the needs of “multi-planning integration” based on “two regulations in one”.During the preparation and revision of the plan,attention should be paid to public participation and information disclosure to create conditions for the improvement of the planning committee system and the planning hearing system.To improve the planning permission system based on planning conditions,we need to strengthen the whole process supervision to ensure that the planning order is effectively maintained while promoting the reform of parallel approval.Perfecting the reasonable compensation,appeal and relief system is the necessary condition to balance the relationship between construction freedom and construction control.
