论法理学与部门法学的二元互动关系

On the Binary Interaction Between Jurisprudence and Department Law

法理学是超越法律并回望法律的学科,解决的根本问题是法律是什么的问题;部门法学是围绕各部门成文法进行解释、建构、加工的活动,形成了部门法教义学。法理学与部门法学之间的良性互动形成了整个法学的良好生态,部门法学的繁荣促进着法理学的积极生长,法理学的发展又回过头来浇灌部门法学。本文立足于法教义学的立场,厘清法理学、法哲学概念,厘清部门法教义学的概念,认为法理学与部门法学的关键区分在于是否受制定法文本拘束,并进一步分析法理学与部门法学的特征和其之间的二元互动关系。

Jurisprudence is a discipline that transcends law and looks back on law.The fundamental problem to be solved is what law is.Departmental law is an activity of interpreting,constructing and processing the written laws of various departments,forming the dogma of various department law.The good binary interaction between jurisprudence and department law has formed a good ecology of the whole legal science.The prosperity of department law promotes the positive growth of jurisprudence,and the development of jurisprudence turns back to water department law.Based on the standpoint of dogma of law,this paper clarifies the concepts of jurisprudence and philosophy of law,clarifies the concepts of dogma of law in various departments,and holds that the key difference between jurisprudence and department law lies in whether they are bound by the text of positive law,to further analyze of the characteristics of jurisprudence and various departments of law and binary interaction.
