论监察取证规则的建构逻辑

On the Logic of the Construction of the Supervision Evidence Collection Rules

随着《监察法实施条例》的出台,以规范监察取证活动为内容的监察取证规则体系渐趋成型,其在衔接侦查取证规则、证据规则的同时体现了自身特色。监察取证规则的独立化旨在适应纪检监察工作规范化法治化发展的改革需要,解决现有规范适用依据不充分的问题,并具有规制监察调查权、保障人权、促进真相发现与发挥证据规则作用的价值。监察取证规则的建构应以监察取证主体的“组织化”认识结构与“廉洁监察”价值追求为理论逻辑,实现求真与求善的有机统一。该规则的理想体系应包括取证主体规则、权利保障规则、证据收集规则、证据审查规则等四类规则。现行监察取证规则基本遵循了上述建构逻辑,同时还应细化相关内容,并着重健全权利保障规则、证据审查规则。

With the promulgation of the Practice Regulation of the Supervision Law,a series of rules focusing on regulating the supervision investigation power have gradually come into shape,which have some special characteristics while well resolving their connection with criminal investigation rules and evidence rules.The independent development of supervision evidence collection rules aims to respond to the requirement of the standardization and legalization of the discipline inspection and supervision reform,resolves the insufficient basis for applying the current law or regulations to regulate the supervision investigation power,and has such values as regulating the supervision investigation power,safeguarding human rights,promoting truth finding,and playing the role of evidence rules.The construction of the rules shall be based on the“organizational”cognition structure and the“supervision integrity”value in order to realize the goal of seeking both truth and goodness.Following this logic,the rules shall include such four types of rules as investigation subject rules,rights protection rules,evidence collection rules and evidence examination rules.The current supervision evidence collection rules generally follow the above logic,but still have room for improvement,in particular,in terms of its rights protection rules and evidence examination rules.
