授权登录模式下,网络开放平台的社会关系链数据权益应当如何分配一直是学界关注的焦点问题,该问题关系到第三方数据迁移行为是否合理。平台固然对自己成本投入的数据享有权益,有权合理限制第三方数据迁移行为,但数据价值在数据流通中得以实现,其数据上的权利并非绝对排他,其范围也并非漫无边际,应当保持数据控制的谦抑。在确立分享作为数据法基本价值取向的理论前提下,个人和平台对社会关系链数据都享有一定权益,平台对第三方数据迁移行为的限制应具有合理前提,应当综合替代性效果分析、数据迁移的正当性和必要性、第三方创新增量等多重因素来判断第三方数据迁移行为是否合理,从而实现多方数据主体的有效互动,规范数据市场秩序,促进数据效能最大化。
