我国藏药专利技术情报及发展对策研究

Research on Technical Information and Development Stratety of Tibetan Medicine Patent in China

藏药并非是对药材来源地区的描述,而是强调传统藏医药理论对于藏药研制创新的指引地位。近年来,随着检验检测手段的更新和药品标准的提升,藏药专利申请数量和质量得到较大提升。本文以国家知识产权局专利数据库、大为专利数据库检索取得的藏药专利信息为研究基础,对藏药申请人、申请领域、国外专利申请情况进行梳理;同时,针对藏药标准滞后、藏药专利申请类型偏差、藏医药传统病症体系判断新用途专利等新问题进行了系统分析,希望能够提高藏药专利申请质量、提升专利布局水平。

Tibetan medicine is not a description of the source region of medicinal materials,but emphasizes the guiding role of traditional Tibetan medicine theory for the research and innovation of drug.In recent years,with the updating of testing methods and the improvement of drug standards,the quantity and quality of Tibetan drug patent applications have been greatly improved.Based on the patent information of Tibetan medicine obtained from the patent database of CNIPA and the Innojoy patent database,this paper sorts out Tibetan medicine applicants,application fields and foreign patent applications.At the same time,systematic analysis has been made on new problems such as lagging standards of Tibetan medicine,deviation of patent application types of Tibetan medicine,and judgment of new use patents according to the traditional disease system of Tibetan medicine,hoping to improve the quality of patent application of Tibetan medicine and the level of patent layout.
