电信网络诈骗犯罪的刑法视角思考

近年来电信网络技术突飞猛进,持续推动我国信息化、网络化社会环境的形成和完善。与此同时,电信网络诈骗犯罪日益猖獗,给广大人民群众造成了严重的经济损失。因此,深入把握电信网络诈骗犯罪的概念、主要方式以及演变过程,从刑法层面保护公民个人信息安全。电信网络诈骗罪应单独入法,科学设置电信网络诈骗罪的刑罚,准确认定电信网络诈骗帮助行为的主观罪过,从司法制度体系完善和机制体制落地层面,铲除电信网络诈骗犯罪的土壤。

In recent years,the rapid development of telecommunication network technology has continuously promoted the formation and perfection of our country’s information and network social environment.At the same time,the telecom network fraud is rampant day by day,so that the broad masses of the people have suffered tremendous economic losses.Therefore,the concept of telecom network fraud crime,the main way and the evolution process should be deeply grasped from the level of criminal law to protect citizens'personal information security.The crime of telecom network fraud should be separately included in the law,the punishment of telecom network fraud should be set scientifically,the subjective guilt of telecom network fraud help behavior should be accurately identified,and the soil of telecom network fraud crime should be eliminated from the aspects of the perfection of the judicial system and the landing of the mechanism system.
