情境式教学方法在高校法学教育中的运用——以“刑事法案例研究”课程为例

摘要 当前高校法学教育主要目标是培养实践导向法治人才,而师资背景、学生素质、课程设置却凸显出“重理论、轻实践”倾向。情境式教学方法以场景创设为手段,以强化学生法律职业者角色为目标,充分调动教师能动性、学生主动性和课堂生动性,在“刑事法案例研究”课程教学中的运用具有必要性、可行性、实效性。刑事案件的真实情境、想像情境和暗含情境可通过视频图片辅助理解、模拟法庭角色扮演、虚拟仿真技术加持帮助学生进入情境,在虚实结合环境中掌握专业知识和实践技能,实现刑法学知识体系贯通、司法实践能力锻炼以及理论应用素质提升。 The main goal of legal education in universities is to cultivate practice-oriented legal talents.However,teachers’ background,students’ quality and curriculum arrangement unavoidably show a tendency of “emphasizing theory other than practice”. The contextual teaching method use scenario creation as the means,aiming at strengthening students’ role of legal professionals,and fully mobilizes teachers’ initiative,students’ proactive and course’s vividness,which is necessary,feasible and effective to apply to the course of “Criminal Law Case Study”. As to the real situation,imaginary situation and implied situation of criminal cases,video pictures,mock courtroom role-play and virtual simulation technology can be adopted to help students entering the context. Thus,students will have a good understanding of both professional knowledge and practical skills in the environment of combination of real and imaginary,coherent the knowledge system of Criminal Law,exercise judicial practice ability and improve the accomplishment of theoretical application.
