治理理论视域下警察权的功能再造

Functional Reconstruction of Police Power from the Perspective of Governance Theory

治理理论认为,治理是一个国家、政府与社会、公民互动协调的过程,国家治理应当具备合法性、适当性、责任性、协作性和效能性五个特征。在国家治理现代化背景下,警察权的社会管理和服务职能得以彰显是时代发展所需,它要求公安机关要学会在服务中实施管理,在管理中体现服务,让管理和服务相互结合和促进。为实现该目的,警察权需要从配置、主体、行使等诸多方面进行审视和重构,以实现自身在国家治理转型格局中功能的精准定位,以确保法定权能得以实现。

Governance theory believes that governance is a process of interaction and coordination among a country, government, society and citizens. National governance should have five characteristics:legitimacy, appropriateness, responsibility, cooperation and effectiveness.Under the background of the modernization of national governance, the social management and service functions of police power are needed for the development of the times. It requires the public security organs to learn to implement management in service, reflect service in management, and combine management and service. In order to achieve this purpose, the police power needs to be examined and reconstructed from the aspects of configuration, subject, and exercise, so as to realize the precise positioning of its functions in the transformation pattern of national governance and ensure the realization of legal powers.
