家国协构视野下乡村彩礼制度的法治出路

The Legal Way out of the Rural Bride Price System under the Perspective of the State-family Association

乡风文明建设是巩固和拓展脱贫攻坚伟大成果、全面落实乡村振兴战略的重要抓手。而近几年农村高额彩礼的婚嫁问题突出,成为影响乡风文明建设进程的热点问题。彩礼作为缔结婚姻关系的支付手段,隐含着社会交换秩序。据此,在分析高额彩礼形成的原因基础之上,提出“家国协构”的法治思想,注重国家法与民间法的协同作用,鼓励公私交融社会法的发展,以期解决公共领域中的高额彩礼问题,促进乡村振兴战略的实施。

The construction of rural customs and civilization is an important way to consolidate and expand the great achievements of poverty alleviation and fully implement the rural revitalization strategy.In recent years, the problem of marriage with high bride price in rural areas has become a hot issue affecting the construction of rural civilization. As a means of payment for marriage, bride price implies social exchange order. Therefore, based on the analysis of the reasons for the formation of high bride price, this paper puts forward the rule of law thought of“family-state association”, pays attention to the synergistic effect of the state law and the folk law and encourages the development of the law of blending public and private society in order to solve the problem of high bride price in the public domain and promote the implementation of the rural revitalization strategy.
