网络开设赌场犯罪涉案资金处置机制之完善

The Perfection of the Disposal Mechanism of the Funds Involved in the Casino Crime on the Network

近年来网络赌博逐渐发展成为重要的赌博方式以及网络犯罪形式,全国网络赌博犯罪案件剧增。网络开设赌场案件涉案账户众多资金数额巨大,资金性质复杂,认定标准不一、相关制度机制滞后、“重人身轻财产处置”观念等原因造成司法实践混乱,资金处置问题不断涌现,易侵犯公民合法财产权利,影响司法公信力。在司法实践中,应当以取证规范为基础强化涉案资金的审查认定,合理把握认定标准,正确界定可以没收的资金范围,从审前、审理、审后三个方面强化利害关系人权利救济体系建设,建立符合程序正义的涉案资金处置程序,维护裁判的准确性,在追诉犯罪没收违法资金和保护公民合法财产权之间保持合理的价值平衡。

In recent years,online gambling has gradually developed into an important way of gambling and a form of cyber crime,and there has been a sharp increase in the number of online gambling crimes across the country.The large amount of funds in the accounts involved in the casino cases on the network are huge,the nature of the funds is complex,the identification standards are different,the relevant systems and mechanisms lag behind,and the concept of"emphasizing the person over the disposal of property"has caused confusion in judicial practice,and the problems of capital disposal continue to emerge.It is easy to infringe upon citizens’legitimate property rights and affect judicial credibility.In judicial practice,we should strengthen the examination and identification of the funds involved in the case on the basis of the norms of obtaining evidence,reasonably grasp the identification standards,and correctly define the scope of funds that can be confiscated.We should strengthen the construction of the relief system for the rights of interested parties from the three aspects of pre-trial,trial and post-trial,establish a procedure for the disposal of funds involved in the case in line with procedural justice,maintain the accuracy of the judgment and keep a reasonable value balance between the prosecution of crimes and the confiscation of illegal funds and the protection of citizens’legitimate property rights.
