依法治理非法穿越自然保护地行为的难点与对策——以陕西太白山国家级自然保护区“鳌太线”为例

Difficulties and Countermeasures of Law-based Management Regarding Illegal Crossing of Protected Natural Area

为减少非法穿越行为对自然保护地自然资源、政府社会管理造成的破坏和影响,以陕西太白山国家自然保护区“鳌太线”为例,分析了非法穿越在破坏自然资源、污染生态环境、造成人员伤亡、浪费社会资源等方面带来的危害,以及包括民众认识不足、穿越行为和社会舆情管控难度大、执法困难多、存在法律法规空白等造成非法穿越难以管理和杜绝的原因,提出了开展广泛宣传、大力营造良好的整治氛围,加强警示教育、筑牢拒绝非法穿越思想防线,严格网信治理、净化网络生态环境,适应保护需要、完善法律法规体系,加大执法力度、严格惩处非法入区行为等管理对策。

To tackle the illegal crossing of nature reserve,Taibaishan National Nature Reserve Administration taking the"Ao-Tai"route as the case,analyzed the negative effects caused by the illegal crossing in terms of natural resources damage,eco-environmental pollution,casualties,and wasting of social resources.The factors concerned were discussed,such as low awareness of the public,difficulties in control of the illegal activities and in legal enforcement,and lack of relevant laws.The countermeasures like strengthening public awareness raising through propaganda,fostering favorable environment for governance,supportive to warning education,strict internet governance,and strict legal enforcement were developed.
