论网络媒体言论自由的规制

On the Regulation of Free Speech in Network Media

网络媒体言论自由是言论自由的外在表现形式之一,其本质体现为法律对于公民在网络空间中合法发表评论、交流思想且不受个人或公权力干涉权利的保护。网络媒体言论自由是维护我党政治意识形态安全、国家政治安全和国防安全、促进我国网络秩序健康绿色发展的应有之义。但由于当前我国监管技术滞后以及立法、执法、司法环节还不够完善,使得我国网络秩序及意识形态安全的稳定性正遭受严峻考验。为此我国应依宪治理以网络谣言为主的不良言论,健全法律规制体系,加强对不良言论的监督,以达到网站空间健康发展、行稳致远之目的。

Free speech in network media is one of the external manifestations,whose essence is that the legal protection of citizens’right to make comments and exchange ideas legally in cyberspace without interference by individuals or public power.It is of the obligation to maintain CPC’s political ideological security,national political security,national defense security and to push the healthy and green development of network order in China.However,due to the lagging regulatory technology and the imperfect legislation,law enforcement and judicial links,there exists a sever challenge for the stability of network order and ideological security in China.Thus,China should control the speeches dominated by Internet rumors according to the laws,improve the legal regulation system and enhance the supervision of those speech,so as to push healthy development of cyberspace with a steady speed.
