少数民族村规民约推动民族地区基层社会治理研究--基于四川省泸州市7个民族乡的田野调查

Studies on the Minority Village Rules and Regulations Promotion of Grassroots Social Governance in Ethnic Areas--Taking 7 Ethnic Townships in Luzhou as an Example

依法进行基层社会治理的背景下,如何更好地发挥少数民族村规民约在民族地区基层社会治理中的积极作用是一个值得深入探讨的问题。泸州市少数民族村规民约实施以后,在制度保障、治理机制、治理方法、治理主体上产生积极效果。此外,“应付”执行、司法审核把关不严、与法律法规抵触、监督和激励机制欠缺等因素也降低了泸州市民族地区基层社会治理的效果。因此,进一步充实完善村规民约的内容,严格把关司法审核程序,强调制定程序的合法性,健全完善监督激励机制对推动泸州市民族地区基层社会治理具有重要意义。

Against the background of grassroots social governance in accordance with the law,how to make better use of the active role of minority village rules and regulations in grassroots social governance in ethnic areas is an issue worthy of in-depth discussion.After the implementation of the minority village rules and regulations in Luzhou,positive effects have been produced in institutional guarantees,governance mechanisms,governance methods,and governance subjects.In addition,factors such as"coping"enforcement,lax judicial review,conflict with laws and regulations,and lack of supervision and incentive mechanisms have also reduced the effectiveness of grassroots social governance in ethnic minority areas in Luzhou.Therefore,it is of great significance to further enrich and improve the content of village rules and regulations in Luzhou,strictly control the judicial review procedures,emphasize the legitimacy of the formulation procedures,and improve the supervision and incentive mechanism to promote grass-roots social governance in ethnic areas.
