构建新型诉讼格局理论是习近平法治思想的原创性成果和开创性贡献,是新时代为解决影响司法公正和制约司法能力的深层次问题而进行的重要司法体制和机制创新,目的在于构建普通案件在行政区划法院审理、特殊案件在跨行政区划法院审理的诉讼格局。地方各级人民法院是行政区划法院,重在审理辖区内占绝大多数、不易受到地方保护和行政干预影响的普通案件,推动矛盾纠纷就地公正解决。跨行政区划法院是综合性专门法院,是对传统专门法院的坚持与发展,重在审理占少数、容易受到地方保护和行政干预影响的特殊案件,推动特殊案件跨行政区划集中管辖和公正审判,有效防止诉讼“主客场”现象,维护社会公平正义。跨行政区划法院按省域内和跨省域两级设置。设置跨行政区划法院离不开司法资源投入保障,应当建立与跨行政区划法院职能定位相适应的综合配套司法保障体系。

The theory of building a new litigation pattern is an original achievement and pioneering contribution of Xi Jinping Thought on the Rule of Law,and an important strategic decision to uphold and develop the socialist judicial system with Chinese characteristics.The construction of a new litigation pattern is an important judicial system and mechanism innovation in the new era to solve the deep-seated problems affecting judicial fairness and restricting judicial capacity,with the purpose of building a litigation pattern in which ordinary cases are heard in the administrative division courts and special cases are heard in cross-administrative division courts.Local people's courts at all levels are administrative division courts,focusing on trying the vast majority of ordinary cases within the jurisdiction of local courts that are not easily affected by local protection and administrative interference,and promoting the fair settlement of contradictions and disputes on the spot.The cross-administrative division court is a comprehensive special court,which is the persistence and development of traditional special courts,focusing on hearing a small number of special cases that are susceptible to local protection and administrative interference,promoting the centralized jurisdiction and fair trial of special cases across regional divisions,and effectively preventing the‘home and away'emergence of litigation and safeguarding social fairness and justice.Cross-administrative division courts are set up at the intra-provincial and inter-provincial levels.The establishment of courts with cross-administrative divisions is inseparable from the guarantee of judicial resource input,and a comprehensive supporting judicial guarantee system suitable for the function positioning of the cross-administrative division courts shall be established.
