新噪声法下江苏省夜间施工噪声防治难点探析

Analysis of Difficult Points on Prevention and Control of Night Construction Noise in Jiangsu Province under The New Noise Law Framework

新修订的《中华人民共和国噪声污染防治法》于2022年6月5日正式施行,噪声法在落实建设单位和施工单位责任、明确夜间施工要求、优先使用低噪声工艺和设备等方面作出了具体规定,给夜间建筑施工噪声污染防治管理带来更大的考验。现阶段,夜间建筑施工噪声污染投诉多、处置难,已成为影响群众健康的主要环境问题,夜间建筑施工噪声污染防治面临着管理体系、措施滞后,防治技术指南、标准不完善,部门联动不畅等问题。结合典型城市管理经验和江苏省实际,建议通过明确责任分工、规范夜间施工审批、建立信息共享机制、加大执法力度、研究相关技术和标准、推广智慧工地建设等措施保障新法落地。

Since June 5,2022,The Law of The People’s Republic of China on The Prevention And Control of Noise Pollution has been officially implemented.The new noise law specifies stipulations on responsibilities of construction units,prerequisites for night construction and demands for priority access to process and equipment with low noises,which has brought greater challenges to prevention and control of night construction noise.At this stage,night construction noise has become a major environmental problem affecting people’s health as it causes lots of complaints and is difficult to deal with.The prevention and control of night construction noise are facing the problems of lagging management system and measures,imperfect technical guidelines and poor department linkage.Referring to the management experiences of typical cities and proceeding from the actual situation of Jiangsu province,we propose to ensure the implementation of the new noise law by clarifying the division of responsibilities,regulating the approval of night construction,establishing an information sharing mechanism,strengthening law enforcement,studying relevant technologies and standards and promoting application of automatic monitoring system on construction sites.
