摘要
本文利用案例研究与司法判决数据,探讨了长期以来政府介入新就业形态用工关系、实施劳动保护的基本模式。文章试图通过嵌入性的概念,将结构性因素与策略选择的微观分析整合起来。结构上,嵌入性描述了新就业形态下劳动法律悬置、政府失去受权的状态,也概括了政府通过已然发生的争议介入劳动保护的途径。具体治理中,政府通过嵌入到文化符号与劳动力供应链之中,发挥能动性,实现基本权益救济的目标。总体上,这种模式仍有“抓手不足”和保障不足的困境。最后,文章提出了相应政策建议。
With a method of case study and content analysis on the judicial cases,we has revealed the pattern of the government’s intervention in the labor protection in gig economy.Invoking the concept of embeddedness,we combine the structural elements with a framework of strategic choice theory.Structurally,embeddedness was invoked to describe both the situation where the government’s lack of authorization due to a grey area of labour law and the approach of intervening the platform economy via disputes resolution.While by embedded in symbolical systems and labor supply chain,government has fulfilled their goal of labor protection.Nevertheless,this pattern are with flaws of’limited approaches’and inadequate protection.At the end of our research,we make proposal on labour protection in gig economy.
