借力PPP模式控制地方政府债务风险研究

Controlling the Debt Risk of Local Government by Means of PPP Mode

由于近几年来国家加强对公共基础设施的建设,导致地方政府的债务量不断增加,随之风险也不断提高。PPP作为一种新型的融资模式,成为缓减地方政府债务增量以及化解债务风险的有效方法之一,但是该模式存在缺乏法律制度保障、投资项目风险分配不公平、未建立必要的监管机制、公私双方未遵守合同条款、政府职能未发生改变等问题。因此,提出了完善PPP模式相关法律、健全PPP模式投资项目风险共担机制、建立PPP监管机制、公私双方遵守PPP项目中的合同条款、政府积极转变职能等解决措施。

In recent years, China has strengthened the construction of public infrastructure, which has led to the continuous debt increase of local governments and the rise of risks. As a new financing mode, PPP has become one of the effective methods to reduce the increase of local government debt and resolve the debt risk. However, this mode has many problems, such as lack of legal system guarantee, unfair distribution of investment project risk, failure to establish necessary regulatory mechanism, failure of public and private parties to abide by the contract terms, and no change in government functions. Therefore, some solutions are proposed, such as perfecting the relevant laws of PPP mode, improving the risk sharing mechanism of PPP mode investment projects, establishing the PPP supervision mechanism,observing the contract terms in PPP projects by both the public and private parties, and exercising active functions by the government.
