“一带一路”背景下贵州企业对外投资的法律风险防范研究

Legal Risk Prevention of Foreign Investment of Guizhou Enterprises under the Background of Belt and Road Initiative

在“一带一路”背景下,贵州省出台了一系列政策措施参与“一带一路”建设,有效带动更多的本土企业“走出去”。企业是“一带一路”倡议的重要实施主体,在此背景下企业对外投资将获得更多的市场机遇,但同时也将面临一系列的法律风险,比如贸易壁垒、知识产权法律风险、环境法律风险、劳工标准法律风险等。政府应建立域外法律信息库、海外投资风险咨询机构以及培养复合型跨国管理人才,为企业对外投资做好信息提供、投资风险分析和人才储备服务。企业应牢固树立法律风险防范意识、知识产权意识和依法合规经营理念,增强社会责任意识,从而实现对外投资的稳步增长。

Under the background of Belt and Road Initiative, Guizhou Province has introduced a series of policies and measures to participate in the construction, so as to effectively drive more local enterprises to go out. Enterprises are important implementers of the Belt and Road Initiative. In this context, enterprises’ foreign investment will gain more market opportunities, but they will also face a series of legal risks, such as trade barriers, intellectual property legal risks, environmental legal risks, and labor standard legal risks. The government should establish foreign legal information database, foreign investment risk consulting institutions and cultivate compound transnational management talents, so as to provide information, investment risk analysis and talent reserve services for enterprises’ foreign investment. Enterprises should firmly establish the awareness of legal risk prevention, intellectual property rights and legal compliance management concept, and enhance the awareness of social responsibility, so as to achieve the steady growth of foreign investment.
