摘要
技术与艺术、实用与美观的融合已经成为现代工业设计发展的一大趋势。陶瓷实用艺术品著作权纠纷类案研究表明,当前陶瓷实用艺术品的著作权司法保护处境尴尬,存在陶瓷实用艺术品与陶瓷美术作品界分不明、陶瓷实用艺术品认定标准多元、可分离性判断标准模糊、独创性认定标准混乱等诸多问题。未来司法实践应当遵循著作权法理,明确实用性是界分陶瓷实用艺术品与美术作品的关键,艺术性是陶瓷实用艺术品作为美术作品而受著作权法的本质,可分离性是陶瓷实用艺术品受著作权法保护的前提,独创性是陶瓷实用艺术品受著作权保护的核心,确立陶瓷实用艺术品著作权保护的体系化思维,走出司法保护的困境。
Studies on copyright disputes over ceramic utility works of art show that the current judicial protection of copyrights of ceramic utility works of art is in an embarrassing situation and there are many problems.Future judicial practice should follow the copyright jurisprudence,make it clear that practicality is the key to distinguishing between ceramic utility works of art and fine art works,artistry is the essence of ceramic utility works of art as works of art and protected by the Copyright Law,separability is the premise of ceramic utility works of art protected by the Copyright Law,originality is the core of ceramic utility works of art protected by copyright,establish the systematic thinking of copyright protection of ceramic practical works of art,and get out of the dilemma of judicial protection.
