“三权分置”背景下我国宅基地退出法律制度研究

Legal Research on Exit of Homestead in China under the Background of“Separation of Powers”

宅基地退出工作对于激活农村沉睡土地资产、赋予农民更大的财产权具有重要意义。各地陆续开展宅基地退出工作并且取得了一定成绩,但是,新的制度在实行过程中不可避免地存在一些不足,例如宅基地产权登记制度不完善、退出程序不健全、退出模式单一、农民利益补偿机制不合理等问题。通过结合试点地区不同模式的已有宅基地退出实践,从而提出应在“三权分置”的架构下,完善宅基地退出相关法律制度,探索宅基地退出的多元路径等建议。

The exit of homestead is of great significance for activating the idle land assets in rural areas and giving farmers greater property rights.The exit work of homestead has been carried out in various places and some achievements have been made,but the new system inevitably has some shortcomings in the implementation process,such as imperfect registration system of homestead property rights,the exit procedure is not perfect,the exit mode is single,unreasonable compensation mechanism for farmers'interests and so on.Based on the existing practice of the exit of homestead in different models in pilot areas,this paper puts forward suggestions such as perfecting the relevant legal system of the exit of homestead and exploring multiple paths of the exit of homestead under the framework of"separation of powers".
