On the Transition from Punishment Execution to Criminal Execution

《中华人民共和国社区矫正法》(以下简称《社区矫正法》)于2020年7月1日正式施行。全国各地在贯彻落实《社区矫正法》的过程中并非一帆风顺,推进社区矫正机构及其工作队伍建设依然面临诸多问题,究其根源在于未能充分理解社区矫正的刑事执行性质,进而认识到应以成立专门的社区矫正机构和建设职业化社区矫正工作队伍为契机,建立统一的刑事执行体制的重要意义。正确理解刑事执行之内涵对构建我国本土化社区矫正制度有着重要意义,并能助力各地司法行政机关开展社区矫正机构及其工作队伍建设,推动我国社区矫正工作进一步法治化、规范化。

The Community Correction Law of the People’s Republic of China(hereinafter referred to as the Community Correction Law)was formally implemented on July 1,2020.The process of implementing the Community Correction Law in all parts of the country has not been smooth sailing.There are still many problems in promoting the construction of community correction institutions and their work teams.The root cause lies in the failure to fully understand the criminal execution nature of community correction,and further realize the important significance of establishing a unified criminal execution system by taking the establishment of specialized community correction institutions and the construction of professional community correction work teams as an opportunity.A correct understanding of the connotation of criminal execution is of great significance to the construction of our country’s localized community correction system,and can help the judicial administrative organs to carry out the construction of community correction institutions and their work teams,and promote the further legalization and standardization of our country’s community correction work.
