未成年人社区矫正适用的实践困境及消解路径

目前,对未成年人进行社区矫正是我国贯彻落实宽严相济刑事政策的要求,也是社会管理创新体制的重要组成部分。它将管制、缓刑、假释、暂予监外执行的罪犯置于社区内,通过矫正其犯罪心理和行为恶习,促进其顺利回归社会。而未成年人在社区矫正实践中仍存在适用效果偏差、执行形式化、部分制度不健全等方面的问题。因此,理应建立有中国特色的未成年人社区矫正制度,提高社区矫正的思想认识,细化社区矫正执行规定,强化社区矫正人财物保障等,进而对未成年人社区矫正制度适用予以完善。

At present,the community correction of minors is the requirement of implementing the criminal policy of tempering justice with mercy in China,and it is also an important part of the innovative system of social management.It places criminals under control,probation,parole and temporary execution outside prison in the community,and promotes their smooth return to society by correcting their criminal psychology and bad habits.However,there are still some problems in the practice of community correction,such as the deviation of application effect,the formalization of implementation,and the imperfection of some systems.Therefore,we should establish a community correction system for minors with Chinese characteristics,improve the ideological understanding of community correction,refine the implementation provisions of community correction,and strengthen the guarantee of human and financial resources of community correction,so as to improve the application of the community correction system for minors.
