摘要
谈判签署可持续发展友好型的经贸协定已成为国际共识。《欧盟—韩国自由贸易协定》(欧韩FTA)首次设置可持续发展章节并为《中欧全面投资协定》(CAI)沿用,成为欧盟在经贸合作领域关注环境和劳工保护议题的典例。“欧韩劳工权利争端案”的实践表明,经贸协定项下的可持续发展劳工保护条款具有法律效力,缔约方应承担相应的责任,否则可能引起国家间争端。该案体现的劳工保护条款审查和适用规则,对我国批准和实施CAI具有启示意义。我国应认识和理解劳工保护条款的义务,重视可持续发展分歧解决机制,促进国内法治与涉外法治的有效联动,从而更好适应国际规则,实现高水平、深层次、制度型对外开放的目标。
It has become an international consensus to negotiate and sign sustainable development-friendly economic and trade agreements.As a typical example of the EU’s focus on environmental and labor protection issues in the field of economic and trade cooperation,the EU-Korea Free Trade Agreement(EU-Korea FTA)introduces Sustainable Development Chapter for the first time.And it’s carried to The China-EU Comprehensive Investment Agreement(CAI).The practice of“EU-Korea Labour Commitments”implies that sustainable development labor protection provisions under trade agreement have the legal effect.Parties should undertake the obligation,otherwise it may cause disputes between states.Moreover,the case embodies the rules of review and application of labor protection provisions,which are instructive for the approval and implementation of CAI.To better adapt to international rules and achieve the goal of high-level,deep and institutionalized opening to the outside world,China should recognize and understand the obligations of labor protection provisions,pay attention to the“Mechanism to Address Differences”,promote the effective linkage between the domestic law and foreign-related rule of law.
