数字化时代的侦查权运行新探

A New Probe into the Operation of Investigative Power in the Digital Age

犯罪的智能化、数字化改变了侦查权的运行。侦查的运作逻辑由因果性转向相关性;呈现方式由痕迹物证转向大数据证据;运作思维由传统侦查思维转向智慧侦查思维。数字化之于侦查使得侦查权呈现出扩张、隐蔽和偏差的趋势。笔者通过树立大数据信仰、以数字化赋能检察机关、算法过程透明化、引入印证证明模式和导入区块链技术等方式,以期侦查人员提升侦查取证、存证能力,强化对案件事实的认定,实现对侦查权的监督,最终规制侦查权的运行。

The intelligence and digitization of crime have changed the operation of investigative power.The operational logic of investigative power has changed from causality to relevance;The presentation mode has changed from trace material evidence to big data evidence;Operational thinking has changed from traditional investigative thinking to intelligent investigative thinking.Digitization makes the investigative power show the trend of expansion,concealment and deviation.By establishing big data belief,empowering procuratorial organs with digitization,making the algorithm process transparent,introducing the confirmation and proof mode and introducing the block-chain technology,the author hopes that investigators can improve the ability of investigation and evidence collection and evidence storage,strengthen the identification of case facts,realize the supervision of investigation power,and finally regulate the operation of investigation power.
