家事审判制度——以马锡五审判方式为借鉴

Family Adjudication System:Taking“Ma Xiwu”Adjudication for Reference

家事纠纷解决的特殊性与对抗性色彩浓厚的普通民事审判程序之间具有内在的紧张关系,这为构建契合家事纠纷解决的审判制度提供了正当性基础。目前我国的家事审判程序尚处于试点之中,并且在具体的司法实践过程中尚存在一些问题亟待解决。纵观世界各国或地区的家事审判程序并基于对家事审判制度本土化的考量,将马锡五审判方式与域外国家或地区的家事审判制度进行对比分析,进而充分吸收、融合、完善我国的家事审判制度。

There is an inherent tension between the particularity of family dispute settlement and the common civil trial procedure with strong antagonism,which provides a legitimate basis for the construction of a judicial system that fits in with the settlement of family dispute.At present,China′s family trial procedure is still in the pilot,and there are a series of problems to be solved in the judicial practice.Based on the consideration of the indigenization of the family justice system,this paper makes a comparative analysis of Ma Xiwu′s judicial method and the family justice system of other countries or regions,so as to fully absorb,integrate and construct the family justice system of China.
