区块链电子证据的效力分析与改进方式探讨

建立在区块链技术之上的电子证据已经广泛运用到我国司法实践当中。相比较于传统电子证据,区块链电子证据可以自证真实、能够原原本本地复原案件,同时不易受到客观因素的影响,且证据采集验证较为容易,使其拥有较高的法律效力。然而当下区块链电子证据也面临自证优势无法得到有效展现、真实性仍有较大限制以及没有全面达到去中心化等问题,为了进一步提高区块链电子证据的法律效力,需要构建健全的区块链电子证据审查体制,进一步细化区块链电子证据存证平台的审查规则,创设有效的区块链电子证据平台,利用不同措施实现对其的规范。

Electronic evidence based on blockchain technology has been widely used in China's judicial practice.Compared with traditional electronic evidence,blockchain electronic evidence can self prove its authenticity and recover cases from the original.At the same time,it is not easy to be affected by objective factors,and it is easy to collect and verify evidence,which makes it have high legal effect.However,at present,blockchain electronic evidence also faces problems such as the inability to effectively show its self certification advantages,great limitations on its authenticity and the lack of decentralization.In order to further improve the legal effectiveness of blockchain electronic evidence,it is necessary to build a sound blockchain electronic evidence review system,further refine the review rules of blockchain electronic evidence storage platform and create an effective blockchain electronic evidence platform,different measures are used to standardize it.
