从“民惟邦本”到“以人民为中心”--中国传统“民本”理念的法理设定及当代传承

From“People are the Foundation of the State”to“People-centered”--The Jurisprudence and Contemporary Inheritance of Traditional Chinese“People-oriented”Thought

“以人民为中心”是习近平法治思想的根本立场。它既是中国共产党人对中国特色社会主义之本质特征的深刻认识和精确把握,也是对马克思主义法学之“人民性”的继承与发展,更是对中国古代“民本思想”的传承与创新,尤其是吸收了如“德主刑辅”“明刑弼教”“援法断罪”“重惜民命”等中国传统法治文化的精华,而且在此基础上予以时代内涵,由此构成了新时期的中国特色社会主义法治文化。中国特色社会主义法治文化的核心是全体人民共同参与,它以人民为主体,在继承和发展中国传统法治文化的基础上,汲取其他国家的优秀文明成果,在社会主义实践中实现社会主义法治文化的自信。

“People-centered”is the fundamental position of Xi Jinping Thought on the Rule of Law.It is not only the Chinese Communists’deep understanding and precise grasp of the essential characteristics of socialism with Chinese characteristics,but also the inheritance and development of the“people’s nature”of Marxist jurisprudence,and more importantly inheritance and innovation of ancient Chinese“People-oriented”thought,especially the absorption of such examples as“bright virtue and careful punishment”,“integrate punishment with education”,“convicted by law”,“cherish people’s lives”and other essence of Chinese traditional legal culture,and give the connotation of the times on this basis,which constitutes the socialist rule of law culture with Chinese characteristics in the new era.The core of the socialist culture of the rule of law with Chinese characteristics is the participation of all the people.It takes the people as the main body,and on the basis of inheriting and developing the traditional Chinese culture of the rule of law,draws on the excellent civilization achievements of other countries,and realize the self-confidence of the socialist rule of law culture in socialist practice.
