通过减少存量、遏制增量打击拐卖妇女、儿童犯罪

Combating Crimes Related to the Trafficking of Women and Children by Closing Historical Cases and Curbing New Cases

理论界和实务界的统计均表明,我国拐卖妇女、儿童犯罪高发期在20世纪80-90年代,进入21世纪,犯罪数量有所下降,这说明我国打击拐卖犯罪特别是遏制新增犯罪方面已经取得了明显成效。徐州铁链女事件引起了各界对于拐卖妇女、儿童犯罪的关注,但是此案发生于十余年前,并不足以说明我国现在遏制新增犯罪方面还存在较大不足。由于刑法坚持从旧兼从轻原则,所以即使现在提高收买被拐卖的妇女、儿童犯罪的刑罚,也不能适用于存量较大的旧案。在此背景下,我们应当在严格依据《中国反对拐卖人口行动计划(2021-2030年)》全方位推动反对拐卖人口工作的基础上,着重通过严格司法大幅度减少旧案的存量,通过完善立法和严格司法坚决遏制新案的增量,引起全社会对于拐卖人口犯罪的关注和警惕,形成对于拐卖人口犯罪的全方位打击。

Statistics from both theoretical and practical fields revealed that in China,the peak period of crimes related to the trafficking of women and children occurred in 1980 s-1990 s and that the number of relevant cases has been decreasing since the beginning of 21 st century,especially in recent years.This shows that China has done a remarkable work in combating crimes related to human trafficking,especially in curbing the increase of new cases.The Xuzhou chained woman incident aroused wide concern over the crimes related to the trafficking of women and children.However,this case happened more than ten years ago,so it is no evidence that there are still major deficiencies in China’s work of curbing new crimes.China’s criminal law follows the doctrine of observing the laws which give a less severe punishment.Therefore,even if we raise the level of criminal punishment for crimes related to trafficking women and children now,the large numbers of past cases will still receive lenient punishment under the old laws.In this context,we should strictly follow the guide of all-round promotion of anti-trafficking work as specified in the China’s Action Plan against Human Abduction and Trafficking(2021-2030),focus our efforts on massively eliminating unresolved historical cases through strict enforcement of justice,build complete legal system to resolutely curb the increase of new cases,and arouse the attention and vigilance of the whole society to human trafficking,until we finally achieve an all-round crackdown on the crime of human trafficking.
