摘要
2021年11月12日廣州市中級人民法院對「康美藥業股份有限公司案」(以下簡稱「康美藥業案」)作出一審判決,引起巨大的反響。康美藥業股份有限公司被判向原告顧華駿、黃梅香等52037名投資者賠償投資損失24.59億元,獨立董事被判在上述賠償總額最高10%的範圍内承擔連帶責任。獨立董事的賠償金額高達2.458億元,史無前例。
On November 12,2021,Guangzhou Intermediate People's Court sued a frst instance judgment on the case of“Kangmei Pharmaceutical Co.,Ltd.Case”(hereinafer refered to as the“Kangmei Pharmaceutical Case”),provoking a huge publie response The judgment ordered Kangmei Pharmaceutical Co Ltd.to compensate 52.037 investors including the Plaintifs Gu Huajun and Huang Meixiang forinvestment loses of RMB 2.459 bilion and its independent diretors to asume joint and several liability for up to 10%of the totalamount of the said compensation implying an amount of compensation from the independent diretors as umprecedentedly high as RMB 245.8 milion.
