网络直播的政府监管:一个整体性治理的视角

Government Supervision of Live Webcast:A Perspective of Overall Governance

整体性治理作为一种新的治理模式,对网络直播政府监管具有可适性,其所包含的公众需求、协调与整合、制度化、技术运用等核心元素,正是网络直播政府监管的重要因素。通过调查,从主体结构、制度体系、技术支撑、利益关系等四个维度构建网络直播整体性政府监管的指标体系并进行实证分析,研究发现:当前我国网络直播政府监管中整体性治理的思维及运用严重不足,主要体现:第一,网络直播政府监管主体结构单一,未能有效与直播平台、直播用户、外部专业技术人员等形成监管合力;第二,网络直播政府监管的相关法律法规仍不够健全、合理与协调;第三,网络直播政府监管仍存在技术性难题,未能形成全流程、一体化、一站式的直播监管体系;第四,网络直播各主体之间利益关系未能整合,相互掣肘情况明显。

As a new governance model,overall governance is suitable for the government supervision of live webcast.It contains the core elements of public demands,coordination and integration,institutionalization,technology utilization,and so on,which are the inherent requirements of the government supervision of live webcast.Based on the questionnaires and literature analysis,this paper constructs the whole government supervision index system of webcast from four dimensions-subject structure,institution system,technical support and interest relationship,and gives the empirical analysis.It is found that the thinking and application of overall governance in the government supervision of live webcast in our country are seriously insufficient,which is mainly embodied as follows:first,the main structure of the government supervision of live webcast is single;second,relevant laws and regulations of government supervision on live webcast are still not sound,reasonable nor coordinated;third,there still exist technical problems in the government supervision of live webcast,and the whole-process,integration and one-stop supervision system cannot be formed;fourth,the interest relationship among various entities of live webcast has not been integrated,and mutual restraints are evident.
