当前警察在现场处置中习惯于通过升级强制力的方式制止违法犯罪行为。此种做法可能导致冲突加剧、造成不必要的伤害和损害警察执法的公信力。根据警察使用强制力的合法性原则、必要性原则和最低限度原则,警察作为影响强制力运用的变量之一,在现场处置中采用强制力降级措施,有助于兼顾执法目的与执法规范、实现程序正义和实体正义的有机统一。为推广实施强制力降级措施,应当减少警察使用强制力升级措施的意愿,构建运用强制力降级措施的长效培训机制,营造警民相互尊重的良好氛围,采取行之有效的强制力降级策略。

At present,the police are used to stopping illegal and criminal acts by upgrading the coercive force in the on-site disposal.Such practices may exacerbate conflicts,cause unnecessary harm and undermine the credibility of police law enforcement.According to the legality,necessity and minimum principles of the police’s use of coercive force,the police themselves can also become one of the variables that affect the use of coercive force.In the on-site disposal,the coercive force degradation measures are adopted so as to give consideration to the purpose of law enforcement and law enforcement norms,and realize the organic unity of procedural justice and substantive justice.In order to promote the implementation of coercive force degradation measures,we should reduce the willingness of the police to use coercive force upgrading measures,build a long-term training mechanism to use coercive force degradation measures,create a good atmosphere of mutual respect between the police and the people,and adopt effective coercive force degradation strategies.
