高速铁路安全防护条例立法理念及相关问题研究

Research on Legislative Concept and Related Problems of Safety Protection Regulations of High-Speed Railway

我国高速铁路线长站多,且高密度行车、高强度运营,面临的安全风险大。各类事故致因复杂,不确定性突出,急需通过法治化治理促进科学运营与精细化管理,以求最大限度地杜绝和减少事故发生。推进高铁安全防护条例立法,首先需以习近平法治思想为指导,把以人民为中心的立法理念贯穿于立法和未来执法落实的全过程。其次应加强党的领导,注重安全防护的过程管理,并从中体现出党的主张和人民意志的高度统一。同时要突出预防为主,坚持正确的立法原则,聚焦防护重点,特别要注重路地协同机制的构建,在立法进程和安全防护实际工作中体现出习近平法治思想的人民性与实践性。另外,要立足中国的法制实践,针对中国铁路安全管理的特点,深入调查研究,直面各种复杂和存在争议的问题,尽可能予以科学定性、正面回应或提出务实可行的建议,全面提升安全工作水平。

The high-speed railway in China faces great safety risks with the conditions of long lines,lots of stations,high traffic density and high operation intensity.The causes of various accidents are complex and uncertain.It is urgent to promote scientific operation and to refined management through legalized governance,so as to eliminate and reduce accidents to the greatest extent.To promote the legislation of high-speed railway safety protection regulations,it is necessary to take Xi Jinping's thought on the rule of law as the guidance and put the people-centered legislative concept through the whole process of legislation and future law enforcement.Also,it is necessary to strengthen the leadership of the Communist Party of China,pay attention to the process management of safety protection,and reflect the high unity of the Party's proposition and the people's will.At the same time,priority should be given to prevention,adhering to the correct legislative principles,focusing on the key points of protection,especially pay attention to the construction of coordination mechanism between railway and local government,and reflecting the people-centered and practical nature of Xi Jinping’s thought on the rule of law in the legislative process and the practical work of safety protection.In addition,based on the legal practice and the characteristics of railway safety management in China,it is necessary to conduct in-depth investigation and research,face all kinds of complex and controversial issues,give scientific characterization and positive responses or put forward practical and feasible suggestions as far as possible,then comprehensively improve the level of safety work.
