在互联网时代背景下,人工智能技术逐渐渗透于刑事诉讼领域,促使司法数据共享化、办案材料数据化、法律决策智能化、诉讼监督动态化和全面化,从而有利于刑事诉讼目的的实现,诉讼效率的大幅度提升,刑事诉讼整体质量的提高,及对司法腐败问题的打击。目前人工智能在我国刑事诉讼领域的应用仍存在不足,主要体现为:削弱了刑事诉讼中控辩双方的平等性,弱化了人员主观能动性,司法数据的公开过程仍不够充分,缺乏复合型的人工智能专业人才等。据此,应从制定健全的刑事诉讼算法归责机制,大力推行使用电子证据并做好行业监管,对人工智能的介入范围进行适当拓展,完善技术建设并培养专业复合型人才,合理运用人工智能技术增强人权保障等方面入手,以弥补人工智能在我国刑事诉讼领域应用的不足,促使刑事诉讼走向智能化、高效化。
