On the Conditions, Path and Mechanism of Establishing Good Laws

良法善治是现代法治的必然趋势。良法以善治为目标,善治以良法为基础。建设法治中国首先要立良法,这既是善治的需要,也是现代法治建设的必然要求。本文突出针对性、实用性、操作性、创新性,深入探讨良法含义,提出良法标准及其操作要求;分析立良法的标准、人才和外部保障条件,提出实现途径把好入口关、起草关、审查关、监督关;务实提出建立健全领导干部有序参与、公众参与和评议、专家咨询论证、评估评价、长效清理等机制。

Good law and good governance are the inevitable trend of modern legal system.Good law aims at good governance,while good governance is based on good law.To build the rule of law in China,we must establish good laws first,which is not only the need for good governance,but also the inevitable requirement of modern rule of law.Focusing on the pertinence,practicality,operability and innovation,this paper deeply discusses the meaning of good law,and puts forward its standards and operational requirements.Then,it analyzes the standards,talents and external guarantee conditions for the establishment of good laws,and put forward the way to achieve this,to attach importance to five key points of the entrance,drafting,review and supervision when making good laws.What s more,we should establish and improve the mechanisms of orderly participation of leading cadres,public participation and evaluation,expert consultation and demonstration,assessment and evaluation,and long-term clean-up.
