知识产权视野下商业数据保护研究

Commercial Data Protection from the Perspective of Intelectual Property Rights

商业数据与知识产权涵盖相似的调整对象,存在权利理论基础的贯通与制度目标的契合,因此知识产权制度在保护商业数据方面具有潜在的适度性。然而,不同于知识产权类型化客体,商业数据在财产形态、利益诉求及价值内涵等方面呈现独立特征,导致既有知识产权制度对商业数据的保护存在适用困境,制度创设成为必要。商业数据法律保护路径的完善,可以借鉴现有知识产权制度原理与规范设计,构建起产权激励、加快数据市场化流通、激活数据要素价值、利益平衡等原则,建立健全以专门法为核心的商业数据保护立法体系,完善权利保护与权利限制的规范构造。

Commercial data is similar to intellectual property in their scope,basis and purpose of protection,and hence the IPR(Intellectual Property Protection)system is potentially adaptable to its protection.However,unlike the categorized objects of IP,commercial data has characteristics of its own in its property form,interest and value,which poses difficulties in the application of the IPR system to its protection,and calls for the creation of its own protection system.However,to improve the legal ways for commercial data protection can learn from the existing IPR system rationale and its designs of norms,so as to establish the principles for encouraging property rights,accelerating the market circulation of data,activating the value factor of data and balancing interests,etc.In this way,a sound specialized commercial dada protection system can be established,with improved norms to protect and limit data rights.
