党内法规程序条款的价值阐述及优化进路

加强程序内容建设是实现“党内法规体系更加完善”的重要抓手。党内法规程序条款具有复合型功能,既能够保证实体内容的正确实施,又内含监督权力运行、加强纪律处分权威性及保障党员合法权益等独立价值。现有党内法规中的程序性规范存在条文数量偏少、流程细节不足、程序性违规违纪后果不明确、救济性条款缺失等问题。我国应当确立混合为主、单列为辅的立规模式,通过完善流程细节、增设程序性制裁规定、补齐权利救济条款等措施,丰富程序性规范的内容,进一步提升党内法规的系统性和科学性。

Strengthening procedural clauses is an important mean to achieve"Improving the system of party rules".The procedural clauses of the party's regulations have a compound function,which can not only ensure the correct implementation of the entity content,but also contain independent values such as the operation of supervision power,strengthening the authority of disciplinary action and protecting the legitimate rights and interests of Party members.There are some deficiencies on party rules,such as insufficient provisions,insufficient process details,unclear consequences of procedural violations,and lack of relief clauses.We should establish a mixed-oriented and single-listed vertical model,enrich the content of procedural norms and improve the systematicness and scientificity of the party rules by improving process details,adding procedural sanctions and completing rights relief provisions.
