生态环境建设中公益诉讼原告资格的研究

Study on plaintiff qualification of public interest Litigation in ecological environment construction

近年来,生态环境受到侵害的案件呈增长趋势,环境公益诉讼逐渐受到了各界的广泛关注。完善的环境公益诉讼是当今中国法治建设不可或缺的一部分。但目前我国对于环境公益诉讼中原告资格方面的规定尚未十分完善。本文通过简单概述环境公益诉讼原告资格的概念及制度发展,分析目前环境公益诉讼原告资格存在的问题,以期为我国环境公益诉讼原告资格标准的完善提供意见。

In recent years,the cases of ecological environment infringement are on the rise,and environmental public interest litigation has gradually attracted wide attention from all walks of life.Perfect environmental public interest litigation is an indispensable part of the construction of the rule of law in China today.However,the provisions of plaintiff's qualification in environmental public litigation are not perfect.This paper briefly summarizes the concept and system development of the plaintiff qualification in environmental public interest litigation,analyzes the problems of current plaintiff qualification in environmental public interest litigation,in order to provide some suggestions to improve the plaintiff qualification standard of our country.
