秦汉《亡律》以往传世文献无载。出土秦汉简则有丰富的《亡律》内容。这些资料表明《亡律》在法律体系中居特殊重要地位。主要体现在:《亡律》针对的逃亡问题是秦及汉初政权面临的主要问题之一;《亡律》并非是与其它律并列的普通律目,而是其它罪定罪时常常不得不使用的律目;《亡律》是《捕律》的逻辑前提。李悝六篇中《网》应为《亡》的讹误。《亡律》属秦汉核心律篇之一。适用社会等级制度的内在变化,《亡律》渐趋简化,逐渐丧失独立成律的地位,在唐律中体现为《捕亡律》中的一部分。

There was no record about The Law of Fugitives of Qin and Han Dynasties before the bamboo slips were unearthed,which are of great importance in the laws and rules of Qin and Han Dynasties.Fugitive was one of the main problems in the Qin and early Han Dynasties.The Law of Fugitives was not an ordinary law parallel to other laws,but a law that had to be used when other crimes were convicted.The Law of Fugitives was the logical premise of the Law of Arresting.In Li Kui’s six chapters,the third chapter Wang(网)should be Wang(亡).The Law of Fugi-tives was one of the core laws in Qin and Han Dynasties.With the change of social hierarchy,the Law of Fuitives tended to be simplifed and gradually lost is independent stalus,and became a part of the law of Arresting Fugitives in the Tang Dynasty.
