新时代地方性法规的功能与实践——以山西“小切口”立法为研究对象

The Function and Practice of Local Regulations in the New Era——Take Legislation on “Small Cuts” in Shanxi as Example

我国实行统一而又分层次的立法体制,省级人大及其常委会和设区市人大及其常委会制定地方性法规是中国特色社会主义立法体制中重要的一部分。地方性法规具有多种法治功能:执行法律、行政法规等国家层面立法;落实、细化上位法;回应地区治理需求,为地区发展提供法治保障;为国家统一立法提供样本和经验等。近年来,山西省人大及其常委会积极创新,采用“小切口”立法形式解决了许多实际问题,为山西经济社会发展提供了重要的法治支撑和保障。

China has a unified and hierarchical legislative system,and the enactment of local regulations by the provincial people’s congresses and their standing committees,as well as the municipal people’s congresses and their standing committees,is an important part of the socialist legislative system with Chinese characteristics.Local regulations have the legal functions of implementing laws,administrative regulations and other national-level legislation,implementing and refining the higher law;responding to regional governance needs and providing rule of law guarantee for regional development;providing samples and experience for national unified legislation.In recent years,Shanxi Provincial People’s Congress and its Standing Committee have actively innovated and adopted “small-cut” legislation to solve many practical problems,providing important rule of law support and guarantee for the economic and social development of Shanxi.
