跨境网络直播诈骗犯罪的特征与对策研究——以2016年至2021年的判决书为研究样本

Research on the Characteristics of Cross-border Webcasting Fraud Crimes and Countermeasures——Take the Judgments from 2016 to 2021 as Study Samples

跨境网络直播诈骗犯罪与传统犯罪相比危害范围更广、危害性更强,给社会治理带来全新挑战。通过实证梳理,归纳该类犯罪的主体特征、行为特征和成本特征,并以此为基点,提出打击犯罪的可行方案。形成预防—侦破—打击—追赃全方位的应对策略,应当加强法治宣传,预防犯罪意识的形成和被害对象的产生;组织多部门广泛参与,建立群防群治体系;提升侦查技术,形成有效震慑态势;跨境侦查协助和建立资产分享制度,构建打击跨境网络直播诈骗犯罪国际合作机制。

Cross-border webcast fraud crimes are more extensivein damage scope and more harmful in damage degree compared with traditional crimes,which brings a new challenge to social governance.Through empirical combing,the subject characteristics,behavioral characteristics and cost characteristics of this type of crime are summarized,and feasible solutions to fighting the crime is proposed based on this.To form an all-round response strategy of prevention-detection-combat-recovery,we should strengthen the publicity of rule of law,prevent the formation of crime consciousness and the generation of victimized subjects;organize a wide range participation of multi-sectors and establish a system of jointly prevention and treatment;enhance the investigation technology to form an effective deterrent posture;assist in cross-border investigation and establish the system of asset sharing and international cooperation mechanism on combating the cross-border webcasting fraud.
