疫情防控之下偷渡犯罪治理困境和对策探讨

Exploring the Dilemma of Governance of Smuggling Crime and Countermeasures to it Under Epidemic Prevention and Control

自改革开放以来,发生在我国的偷渡犯罪有了新的情势和发展,偷渡犯罪与跨境电信诈骗犯罪交织、跨境婚姻中的偷渡现象突出,特别是在疫情防控常态化的形势下,偷渡犯罪与新冠疫情相互影响,使得其社会危害性不断加重,新的犯罪特点给公安机关在边境管控、预防侦查犯罪以及全链条打击犯罪带来了重重困难,因此需要对新的犯罪现状进行梳理,从而有针对性地提出治理对策。文章从公民意识、法律规范、技术手段以及国际合作方面提出综合治理对策,以解决偷渡犯罪治理过程中的各项难题,维护我国的边境安全和国家安全。

Since the reform and opening up,the smuggling crimes occurring in China have taken on a new situation and development that smuggling crimes and cross-border telecommunication fraud crimes are intertwining,smuggling in cross-border marriages is prominent,especially under the situation of normalization of epidemic prevention and control.Smuggling crimes and the new epidemic are influencing mutually,which increases its social harm and brings more difficulties for public security organs in border control,crime prevention and detection as well as the whole chain of crime fighting.So it is necessary to sort out the new crime status,and to propose targeted countermeasures for governance.The article proposes comprehensive management countermeasures in terms of citizens’ awareness,legal norms,technical means and international cooperation in order to solve various difficulties in the management of smuggling crimes and maintain China’s border security and national security.
